Terms and Conditions
We kindly ask our customers to read the following terms and conditions and to tick the box on the order page before placing an order online.
Products
All products are subject to availability. In the event of supply difficulties we reserve the right to substitute flowers, containers, gift items and packaging of equivalent value and quality. We will contact you only when we feel it is necessary.
Some flowers and plants may be harmful or poisonous. Do not consume. Keep out of reach of children and animals and wash your hands after handling your flowers. If unsure, please call us before placing your order.
Delivery
Please place your online order by 12 noon UK time for next day delivery. For same day delivery please telephone 01225 700020.
We do not make deliveries on Sundays (except on Mother's Day, Valentine's Day and Christmas Eve) or UK bank holidays. Online orders made by you on these days will be processed on the next working day, with delivery available the following day after that.
Stems Florist does not guarantee any delivery time for gift orders though you may specify an AM or PM preference. Please note this is only a preference though we will do our best to deliver at that time of day.
Please ensure the recipient’s correct full name, address and contact details are provided, along with your contact details. In the event of any delivery problems Stems Florist will not accept responsibility for orders being delayed by incomplete or incorrect information. We shall not accept responsibility where goods have been correctly delivered to the address provided if the intended recipient has moved or lives elsewhere.
Should the recipient not be at home, we will attempt to deliver to a neighbour or place the order in a considered safe place at the delivery address. A card will be posted through the letterbox informing the recipient of the location of their flowers.
In the instance of there being difficulties in delivering your order we reserve the right to contact the recipient using the contact details you provide though we will usually try to contact you first.
In the event of delivery difficulties due to adverse weather conditions, we will contact you to discuss delivery arrangements.
Delivery charges are not included in the online product prices.
Cancellation
Orders may be amended or cancelled up until 12 noon UK time on the date prior to delivery. Should you need to cancel or amend your order please notify us as soon as possible on 01225 700020. If your order has been made up or if you have requested specific items you may be charged fully or in part. Where the customer exercises their right to cancel we will return their money to their account within 30 days of cancellation.
Liability
If the products we deliver are not what you ordered or if they are of unreasonable quality we shall have no liability to you unless you notify us of the problem within 3 days of delivery. Where possible we will ask to see the product concerned to identify the problem.
We shall have no liability to you where the flower care instructions supplied with the flowers have not been followed.
We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so that is caused by any event or circumstance beyond our reasonable control including breakdown of systems or network access, flood, fire, explosion or accident.
Security and Privacy
All customer details are kept strictly confidential. Your credit card details are sent securely through PayPal and are never stored or seen by us.
All security responsibilities transfer to PayPal.
General
We reserve the right to supplement and amend the terms and conditions from time to time. It is your responsibility as a customer to review them on each occaion you access the Stems Florist website.
Your purchase will be deemed to have occurred in the UK. These terms and conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.
